Terms of Service

These terms apply to services sold by Tyndall Digital LLC, a Pennsylvania limited liability company, and to your use of this website. Sending an inquiry through the site doesn't commit either of us to anything. Signing an engagement document or paying an invoice means you agree to these terms.

Software architecture and custom software, in two forms. Architect on call: design reviews, code reviews and scoping for people building their own software, usually billed by the hour. Custom builds: software built around how your business works, usually scoped as a project.

Every engagement gets its own written agreement (an engagement note, proposal or statement of work) that sets out the scope, what done looks like, the timeline and the payment terms. If that document and this page ever disagree, the engagement document wins.

Prices are in US dollars unless the invoice says otherwise. Invoices are processed through Stripe and are due on the terms shown on the invoice. Hourly work is billed for time delivered. Scoped work is billed on the schedule in the engagement document. Work starts once the deposit or first invoice is paid, unless we agree otherwise in writing. Refunds work as described in the refund policy.

Custom work I build for you is yours once it's paid for: the code, the files, the data and the documentation. For review work, your code and documents stay yours, and my notes and recommendations are yours to use however you like. I keep the right to reuse the general methods, patterns and tools I bring to every engagement, but never anything that contains your private material. If an engagement document says something different about ownership, it wins.

What done looks like is agreed in writing for each engagement. Beyond what that document says, services are provided as-is. I work with third-party AI models, platforms and services that I don't control, and I can't promise how they behave, what they cost, or whether they stay available. My total liability for any claim is capped at the amount you paid me for the engagement the claim relates to.

I show up prepared and treat your business, your code and your data with care. You agree to give me honest access to what the engagement needs and to use what I build within the law. Either of us can end an engagement early; you pay for work delivered up to that point and no more.

These terms are governed by Pennsylvania law. If some part of them turns out to be unenforceable, the rest still stands.
